Photographer Jeff Sedlik, who sued Kat Von D for using his Miles Davis photo as a tattoo, has been granted a jury trial. This decision was influenced by the U.S. Supreme Court's Andy Warhol ruling, emphasizing the need for a jury to determine if the tattoo has transformative characteristics. The case will also consider social media posts related to the tattoo. The trial is set for November 28 and could establish a precedent for fair use and copyright in such cases.
